Regulation (EU) 2023/988 · Article 16
On your own store nobody suppresses the listing. The risk lands elsewhere.
Shopify has no compliance field to fail. That is the trap: a store selling into the EU carries exactly the same obligations, but nothing warns you, and the first signal is usually a customs hold or a letter.
No gatekeeper, same rules
A marketplace enforces the rule for its own protection. A direct-to-consumer store has no such mechanism, so the obligation sits entirely with you and surfaces later, when a shipment is stopped or an authority writes.
The absence of a warning is not the absence of a requirement.
Where the details belong on a store
The name and address of the responsible person go on the product itself or its packaging, and should also appear in the product information on the site. Many stores add a compliance line to the product template and a short section in the footer.
Doing both means a customer, a courier and an inspector all find the same answer in the same form.
Customs is the enforcement point
For direct shipments, the check often happens at the border rather than on the website. Parcels without an EU operator identified on the packaging can be held, returned or destroyed, and the cost falls on the seller.
A correct label block is what keeps the parcel moving.
Included in every plan
Unlimited products, the written designation, the address that goes on the label and a register entry that turns red the day the mandate ends.
We would rather you could prove the appointment than merely assert it.
Why the code matters more than the price
Anyone can print a name on a label. The question an inspector or a marketplace asks is whether that name is really bound to you, today.
Our register answers that in one scan, and it answers honestly: if the mandate has lapsed, it says so.
Questions we are asked
Nothing on Shopify asks me for this. Am I sure it applies?
Yes. The obligation comes from the regulation, not from the platform. Shopify simply does not police it, which is why direct sellers tend to discover it at the border.
Where exactly do I put the details?
On the product or its packaging as the primary location, and in the product information on your site as the practical one. The label is what customs reads; the site is what the customer reads.
Does a fulfilment partner in the EU cover me?
No. Storing goods in the Union does not make the warehouse your responsible person. The role requires a written mandate and someone who accepts the obligations.
Selling direct removes the gatekeeper, not the rule. The compliance you skip is simply deferred to the least convenient moment.
