Regulation (EU) 2023/988 · Article 16

Twelve items. If all twelve are true, a check is uneventful.

This is the list we work through with new clients. It is short on theory and arranged in the order that things actually go wrong.

Before the product ships

An economic operator established in the Union is appointed in writing. The manufacturer's details and the operator's details are on the product or its packaging. A type, batch or serial number allows the specific item to be identified.

Warnings and instructions are present in the languages of the markets you sell into, and the risk analysis behind them is written down rather than assumed.

Before the listing goes live

The compliance field on each platform carries the same operator as the label, with no discrepancy. Safety information appears in the listing itself where the platform requires it.

Images show the actual product with its actual markings, because a photograph of an unmarked sample is a finding waiting to happen.

While you are selling

The technical file is retrievable within days, not weeks. Complaints and incidents are logged, because the obligation to report a dangerous product runs from the moment you know.

The appointment is current: an expired mandate is functionally the same as never having had one, and it is visible the moment someone checks the code.

The four things you receive

Mandate, label block, live verification code and a staffed contact address inside the Union, all issued the same working day.

Every one of them is meant to be checked by someone who has no reason to believe you.

Built to be verified by a sceptic

We assumed from the start that the person reading your label would rather not take your word for it.

Everything in the service is shaped around that assumption, which is why it holds up when it is tested.

Questions we are asked

How long does it take to get through this list?

For a seller with existing documentation, an afternoon. For one starting from a supplier's word and nothing else, longer — the risk analysis and the test reports are the slow parts.

Which item is most often missing?

Traceability markings, followed by warnings in the right languages. Both are cheap before a production run and expensive after one.

Do you check the list for me?

On the plans that include a review, yes: we go through your file and label and tell you what is missing before an authority does.

Nothing on this list is difficult. What makes it hard is doing it after the goods have already shipped.
