Who has to appoint one

Manufacturers and online sellers outside the Union placing outdoor furniture and structures on the EU market. Wooden products additionally bring the seller within the deforestation regime as an operator or trader, which requires a due diligence statement before the goods can be placed on the market.

Thresholds and exemptions

None under GPSR. Under EUDR the obligations are lighter for small and medium operators and start later, but the products remain in scope and the due diligence statement is still required.

What must appear on the label

Manufacturer and responsible person details with an EU address, model and batch identification, maximum user weight for seating and hammocks, wind class or anchoring requirements for gazebos and parasols, assembly instructions and safety warnings. For wooden products, the due diligence statement reference must be available in the supply chain.

Marketplace fields

Outdoor furniture is heavily seasonal and heavily inspected: marketplaces check the responsible person block, and authorities run coordinated sweeps in spring on stability and load-bearing claims.

Documentation you must hold

Technical documentation with the risk analysis covering stability, load, entrapment, sharp edges and weathering. Load and stability test reports. REACH evidence for coatings, treated timber and any plastic components, in particular polycyclic aromatic hydrocarbons in rubber and plastic parts. For wooden items, the EUDR due diligence statement with the geolocation of the plots, evidence of legality in the country of production, and the risk assessment.

Standards and testing

EN 581 series for outdoor table and seating furniture, covering safety, strength and durability. EN 16434 and EN 16433 for parasols. EN 1129 and related standards for folding items. Weathering and corrosion testing for metal frames. PAH content testing on rubber and plastic parts under REACH entry 50.

Language requirements

Assembly instructions, load limits and warnings in the language of each member state of sale. Anchoring instructions for gazebos are safety information and must be translated, not left as pictograms.

When it applies

Before the product is made available. EUDR obligations apply from 30 December 2025 for large and medium operators and 30 June 2026 for micro and small enterprises, subject to the postponements adopted at EU level.

How long records are kept

Technical documentation ten years under GPSR. Due diligence records five years under EUDR.

What happens if you do not comply

Withdrawal and recall, Safety Gate alerts — collapsing gazebos and chairs are a recurring alert category — and national fines. Under EUDR, fines of at least 4% of EU turnover, confiscation of the goods and of the revenue, and temporary exclusion from public procurement.

Who enforces it

National market surveillance authorities for safety, and the competent authorities designated for EUDR plus customs for the deforestation side.

Where the boundary lies

A wooden garden set sits in two regimes at once: EUDR for where the timber came from, and GPSR for whether the chair holds a person. They are enforced by different authorities and neither substitutes for the other. A garden game — giant chess, lawn croquet — presented for children is a toy, with CE marking and EN 71 testing.

Questions we are asked

We import finished furniture, not timber — does EUDR apply?
Yes. Wooden furniture is listed in Annex I, and the due diligence duty runs back to the geolocation of the plot where the tree grew.
Is a stability test really needed for a chair?
EN 581 exists because outdoor seating fails under load and weathering. Without a test report the risk analysis has nothing behind it, and in an injury claim that is the document you will be asked for.
