Who has to appoint one

Manufacturers and sellers outside the Union placing radio-controlled models and hobby kits on the EU market. Classification depends on the intended user: a model marketed for children under 14 is a toy, one marketed for adult hobbyists is a consumer product with radio and battery obligations.

Thresholds and exemptions

Toy classification turns on the intended user. Model aircraft above 250 grams fall within the drone Regulations with class marking and operator registration.

What must appear on the label

CE marking, manufacturer and EU representative details, model and batch identification, radio parameters, battery markings, and for toys the age marking and Annex V warnings. Model aircraft in scope carry the class identification label.

Marketplace fields

Marketplaces check the responsible person and, for flying models, the class marking. Lithium polymer batteries sold with models face transport restrictions and dedicated warnings.

Documentation you must hold

EU declaration of conformity, technical file, radio and safety test reports, EN 71 test reports where the product is a toy, battery documentation with UN 38.3 summaries, and battery, WEEE and packaging registrations.

Standards and testing

EN 71-1 and EN 71-3 for toys, radio testing under the applicable harmonised standards, IEC 62133 for cells, and for flying models the requirements of Regulation 2019/945 where in scope.

Instructions, warnings and charging safety information in the language of each member state of sale.

How long records are kept

Ten years.

What happens if you do not comply

Withdrawal and customs refusal, and separately enforcement against unmarked flying models, which cannot lawfully be operated in the open category.

Who enforces it

Market surveillance authorities, radio regulators, aviation authorities for flying models, and battery registers.

Where the boundary lies

Lithium polymer packs sold loose are dangerous goods with their own transport regime, and the charging warnings are a recognised fire hazard control. A model marketed to adults but sold in a toy department will be assessed as a toy.

Is an RC car a toy?

If it is intended for play by children under 14, yes, with CE marking under the Toy Safety Directive and EN 71 testing. Adult hobby models follow GPSR plus the radio rules.

Do model aircraft need class marking?

Above 250 grams, or where operated in the open category, the drone Regulations apply with class identification and operator registration.
