Who has to appoint one

Manufacturers and sellers outside the Union placing optical instruments on the EU market. Thermal imaging and night vision devices are additionally dual-use items subject to export control, which affects intra-company transfers as well as sales.

Thresholds and exemptions

Dual-use thresholds are technical, based on resolution, frame rate and spectral range, and are set out in Annex I of Regulation 2021/821.

What must appear on the label

Manufacturer and responsible person details, model and batch identification, and for powered or connected instruments CE marking, electrical ratings and the WEEE symbol. Laser rangefinders carry the laser class marking.

Marketplace fields

Marketplaces restrict thermal and night vision optics in several member states, and export control screening applies to shipments even inside the Union in some cases.

Documentation you must hold

Technical documentation and risk analysis, electrical and radio documentation for powered models, laser safety classification for rangefinders, and export control classification for thermal and night vision products.

Standards and testing

EN 60825-1 for laser safety where a rangefinder or pointer is included, electrical and EMC testing for powered instruments, and optical performance verification where magnification or resolution is claimed.

Language requirements

Instructions and safety warnings, in particular the warning never to view the sun, in the language of each member state of sale.

When it applies

Before placing on the market. Export control licences must be obtained before shipment where the item is listed.

How long records are kept

Ten years, and export control records per national law.

What happens if you do not comply

Withdrawal and fines under product law, and separately criminal penalties for unlicensed export of controlled dual-use items, which is enforced seriously.

Who enforces it

Market surveillance authorities, customs and national export control authorities.

Where the boundary lies

Thermal imaging is the trap: a hunting scope can exceed the dual-use thresholds and require a licence, and sellers who treat it as ordinary consumer optics discover this at customs. Laser rangefinders bring laser safety classification on top.

Are thermal scopes export controlled?
Above defined resolution and frame rate thresholds, yes, under Regulation 2021/821, with licensing required for export and in some cases for transfer.
Do telescopes need CE marking?
Only if they contain electrical or radio components. Purely optical instruments follow GPSR.
