Who has to appoint one

Manufacturers and sellers outside the Union placing pools, water toys and swimming aids on the EU market. Classification decides everything here, and the same inflatable ring can fall in three different regimes depending on how it is presented.

Thresholds and exemptions

None. Volume is irrelevant; the classification is what changes the obligations.

What must appear on the label

For toys: CE marking, the Annex V warning 'Only to be used in water in which the child is within its depth and under supervision', manufacturer and EU operator details, age marking and batch number. For buoyancy aids classified as PPE: CE marking with the notified body number, the buoyancy rating and the user weight range. Pools require assembly, anchoring and supervision warnings.

Marketplace fields

Marketplaces suppress water products lacking the mandatory supervision warning, and drowning-risk items receive priority enforcement in spring and summer sweeps.

Documentation you must hold

Declaration of conformity, technical documentation, safety assessment covering drowning, entrapment, suffocation and chemical hazards, and test reports. For PPE-classified aids, the EU type-examination certificate.

Standards and testing

EN 71-1 mechanical and physical properties including the specific requirements for water toys, EN 71-3 chemical migration, EN ISO 25649 for floating leisure articles, and EN 13138 for buoyancy aids for swimming instruction. Phthalate limits under REACH entry 51 apply to soft PVC items.

Language requirements

Warnings and instructions in the language of every member state of sale. Supervision warnings are safety-critical and cannot be pictogram-only.

When it applies

Before placing on the market, and in the online listing before purchase where the warning affects the purchase decision.

How long records are kept

Ten years from placing on the market.

What happens if you do not comply

Recalls and Safety Gate alerts are frequent in this category, and drowning-related incidents attract prosecution in several member states. Phthalate content in soft PVC is a recurring ground for border rejection.

Who enforces it

National market surveillance authorities and customs.

Where the boundary lies

A swim ring presented as a toy is a toy. A device presented as a swimming aid for instruction is EN 13138 and can be PPE. A device presented as a lifesaving aid is Category III PPE requiring a notified body. Marketing wording alone can move the product between these, which is why listings are drafted carefully or challenged.

Do armbands need CE marking?

Yes, and the classification depends on the claim: a toy under the Toy Safety Directive, a swimming aid under EN 13138, or PPE if presented as protecting against drowning.

Is a paddling pool a toy?

Usually yes if intended for children under 14 for play, which brings the supervision warning and EN 71 testing.
