Do you need a DSA legal representative?
Four questions. We tell you honestly, including when you do not need one.
What does your service do?
Does your company have an establishment in the EU (a company, branch or office)?
Do you offer the service in the EU — a significant number of users there, or services aimed at EU countries (language, currency, EU domain, ads)?
Is the service offered in the Czech Republic too?
You provide an intermediary service in the EU without an establishment there, so Article 13 DSA requires you to designate one in writing and publish its details. We can do it today: the type of service you chose is already filled in on the form.
Appoint Europe Services SEArticle 13 applies only to intermediary services: mere conduit, caching and hosting, including online platforms and marketplaces. If you only sell your own products or publish your own content, it does not apply. You may still need a GDPR representative or a GPSR responsible person.
Check the GDPR and GPSR obligationsArticle 13 applies only to providers with no establishment in the Union. With an establishment in the EU, your obligations under the DSA are handled through it, and the Digital Services Coordinator of that Member State is competent.
The DSA applies when you offer services in the Union: a significant number of users in a Member State, or activities aimed at one or more Member States. If that changes, the obligation starts from that moment.
A legal representative must be located in a Member State where you offer your service. We are established in Prague, so we can only act if your service is also offered in the Czech Republic. Choose a representative in one of your Member States. If your service is open to Czech users too, answer Yes and we can help.

Questions
Who needs a legal representative under the DSA?
Every provider of intermediary services — mere conduit, caching or hosting, including online platforms and marketplaces — that has no establishment in the EU but offers its services in the EU. Company size does not matter.
Why must the Czech Republic be one of my Member States?
The legal representative must be established in a Member State where you offer your services. We are in Prague, so your service must also be offered in the Czech Republic.
Who is notified, and when?
After approval we notify our name, postal address, email address and telephone number to the Czech Telecommunication Office (ČTÚ), the Czech Digital Services Coordinator, and we inform it again if the mandate ends.
What do I have to publish?
Our details as your legal representative, in your terms of use or another page that is easy to find. We give you the exact text, and a public page you can link to.
Do you moderate content or answer users' complaints?
No. We receive and forward communications from authorities and act as your representative. Content moderation, notices and complaints remain your responsibility, through your own contact point for users.
Can I cancel?
Yes, at any time and with no notice period. We confirm in writing, issue no further invoice and inform the ČTÚ.
One designation. Every Member State. ČTÚ notified for you.
