Who has to appoint one

Manufacturers and sellers outside the Union placing lubricants and car care chemicals on the EU market. Several member states operate producer responsibility schemes for waste oils requiring registration and levies.

Thresholds and exemptions

CLP applies to classified mixtures at any pack size. Waste oil scheme thresholds are national.

What must appear on the label

CLP pictograms and statements where classified, product identifier, nominal quantity, the supplier's EU details and the UFI code. Antifreeze containing ethylene glycol requires the bittering agent in several member states and specific child safety warnings.

Marketplace fields

Marketplaces check CLP labelling, and liquids face transport restrictions. Antifreeze and brake fluid are frequent subjects of accidental ingestion warnings.

Documentation you must hold

CLP classification file, safety data sheet per language, poison centre notification with UFI, REACH registration or downstream user documentation, and waste oil scheme registration where required.

Standards and testing

Classification testing or calculation, and performance testing against the specification claimed, such as API or ACEA grades, which are substantiable claims.

Language requirements

Label and safety data sheet in the official language of each member state.

When it applies

Notification before the first sale in each member state.

How long records are kept

Ten years.

What happens if you do not comply

Withdrawal and fines, plus retroactive levies where waste oil registration is missing. Performance claims that testing does not support are treated as misleading commercial practices.

Who enforces it

National chemicals authorities, poison centres, environmental agencies and customs.

Where the boundary lies

Specification claims such as an ACEA sequence or an OEM approval are verifiable and are challenged commercially as well as by authorities. Waste oil producer responsibility is national and sits outside any EU-level appointment.

Questions we are asked

Is engine oil classified under CLP?
Many formulations are, and even unclassified ones need a safety data sheet on request and correct product identification.
Can we claim an OEM approval?
Only if the approval genuinely exists for that formulation. Unsubstantiated approval claims attract both authority and manufacturer action.
