Who has to appoint one

Anyone placing electronic cigarettes or refill containers on the market of a member state.

Thresholds and exemptions

None. Every product presentation and every nicotine strength is notified separately.

What must appear on the label

Nicotine content and delivery per dose, ingredient list, health warning covering 30% of the front and back surfaces, child safety information, batch number and the manufacturer's or importer's contact details.

Marketplace fields

Marketplaces require the national notification identifier and refuse cross-border listings in many member states.

Documentation you must hold

EU-CEG notification per member state, toxicological data on the ingredients when heated, emissions testing and a market study.

Standards and testing

Emissions and nicotine delivery testing, leak-proofing and child-resistance for containers.

Language requirements

Label and warnings in the language of each member state of sale.

When it applies

Notification six months before placing on the market in each country.

How long records are kept

For as long as the product is on the market, plus national retention rules.

What happens if you do not comply

Seizure, prohibition of sale and fines. Several member states also ban distance selling of these products outright.

Who enforces it

National health ministries and market surveillance authorities.

Where the boundary lies

Distance selling of e-cigarettes to consumers is prohibited in a number of member states regardless of notification. Nicotine pouches follow national rules that differ sharply and are not harmonised at EU level.
