Who has to appoint one

Manufacturers and sellers outside the Union placing barbecues and outdoor heaters on the EU market. Gas models are gas appliances requiring EU type-examination; charcoal and electric models fall under GPSR or the electrical rules, with the cooking surfaces in the food contact regime.

Thresholds and exemptions

None. Portable gas barbecues and patio heaters are fully in scope of Regulation 2016/426.

What must appear on the label

For gas models: CE marking with the notified body number, the appliance category, the gas types and supply pressures for each member state, the data plate and the installation and use instructions. For all models: manufacturer and EU operator details, batch identification, and the food contact indication for grates and plates.

Marketplace fields

Marketplaces require the notified body number for gas products and remove listings that show only a generic CE logo. Patio heaters have been recalled repeatedly for tip-over and gas leak risks.

Documentation you must hold

EU type-examination certificate and technical file for gas appliances, declaration of conformity, food contact declaration of compliance and migration data for cooking surfaces, and packaging and, for electric models, WEEE registration.

Standards and testing

The applicable EN standards for gas barbecues and patio heaters covering combustion, stability, temperature and leak tightness; migration testing for enamelled or coated grates; and stability testing for tall heaters.

Language requirements

Installation, use and gas connection instructions in the language of each member state, including the gas categories available in that country, since supply pressures differ across the Union.

How long records are kept

Ten years.

What happens if you do not comply

Recall and Safety Gate alerts. Carbon monoxide and gas leak incidents make this one of the most aggressively enforced consumer categories, with immediate withdrawal rather than negotiated correction.

Who enforces it

Market surveillance authorities, gas safety bodies, food safety authorities for the cooking surfaces, and customs.

Where the boundary lies

Gas categories differ by member state, so a single specification does not serve the whole Union: an appliance set for one gas type and pressure may be unlawful elsewhere. Charcoal models avoid the gas regime but keep the food contact and stability obligations.

Only if it is approved for the gas categories and pressures of each country you sell into, and the instructions state them.
Do barbecue grates need food contact documentation?
Yes, they contact food directly and require a declaration of compliance with migration data, especially where enamelled or coated.
